Child custody and paternity are two terms familiar to anyone going through a divorce or child support case.

The law is clear that every parent must financially support their children, regardless of each parent’s involvement in the child’s life. Most states use a calculator to determine which parent will pay child support and what the monthly amount will be. Typically, the court will evaluate each parent’s income, overnights with the child, daycare or medical costs, and other qualified expenses.

What many parents don’t realize is that before the court can order child support & custody, you’ll need to establish paternity. Determining the answer to the seemingly simple question “who is the father?” may be more complicated than you think.

One of the biggest questions of divorce may center on whether one spouse will be entitled to alimony and/or child support.

Alimony, or spousal support, is generally intended to help the spouse receiving it maintain a similar lifestyle to the one they were accustomed to during the marriage. Alimony is not granted automatically—the spouse needing the alimony has to ask for it.

The key difference between alimony vs. child support is what each one is intended to be used for. Alimony is paid for the benefit of a spouse; child support is paid for the benefit of any children resulting from the marriage.
